Every month, a reader asks one of our sponsor legal experts about a work-related issue. These building trades law professionals respond in an Organized Labor exclusive. This month’s expert is Jonathan Davis of the Arns Law Firm.

I was injured using equipment that malfunctioned. We followed the instructions and operated the equipment as directed. There were no warnings that we could be injured operating the equipment and the user manual did not have instructions or warnings either. I have a workers’ compensation claim, is there anything else I can do?

You may have a product’s liability claim against the designer, manufacturer or whoever sold the equipment. Equipment must operate safely and have adequate warnings, instructions, and safeguards. If the equipment malfunctioned, the instructions were incomplete, or the manufacturer failed to properly warn of potential dangers, you may have a right to a third party lawsuit. Contact a lawyer and make sure the equipment is preserved as evidence immediately.
